Define access to justice and give the act that allows legal aid.
Access to justice involves being able to fund the costs of a case. This is problematic as there can be large fees.
The legal aid, sentancing, and punishment of offenders act 2012 (LASPO)
Where is legal aid available and where is it not available.
Legal aid is available where the case is serious. Or where the person can’t pay legal fees. The case has to be eligible. For example legal aid is available where a person is at risk of losing their house.
Legal is is NOT available for medical negligence, trespass to person land or property.
How is it decided if someone is eligible for legal aid?
A persons ability to pay is means tested. This includes both income and property meaning people who own their home are not eligible even if they have no disposable income.
