Retribution: Aims
- Based on the idea that the offender deserves punishment
- It contains an element of revenge e.g., ‘an eye for an eye, a tooth for a tooth’
- Proportionality: ‘tariff system’ e.g., X number of years for armed robbery
- Supported by the sentencing council which provides the guidelines for courts on the appropriate punishment.
- Backwards looking theory- looks to the past to deter the future
Retribution: Link to theory
Rational choice theory- Considers a fitting method of punishment as it ensures the offender is punished appropriately.
Functionalism- Punishing offenders reminds everyone else what is right and wrong
Premise- Offenders continuously choose to commit crime and therefore should be responsible for the actions
Retribution: Critisisms
- Offenders deserve forgiveness and a chance to make amends
- Punishment should be served even when no good will come from it
- Just deserts: how can we decide if a punishment is ‘just’?
Rehabilitation: Aims
-To reform offenders ad reintroduce them to society
-A forward looking aim with hope that their behaviour will be altered and won’t re offend.
_Presumes criminal behaviour is a result of freewill and a rational choice
-Rehabilitation policies include: education & training programmes, anger management courses, drug treatments and community sentences
