Conditional Use
Provision in a zoning ordinance allowing prohibited use if conditions are met.
Zoning
Division of a jurisdiction into districts/ in which use of land and developments are permitted or prohibited. Enforced by states and local government.
Variance
A variance is granted by the board of adjustments/ when enforcement of an ordinance would result in hardship in the landowner.
Tenancy for Years
Type of leasehold estate, / for fixed period of time,/ can be for more or less than a year /and expires at the end of stated period.
Periodic Tenancy
Type of leasehold estate, which is period to period and terminated through proper notice.
Tenancy at Will
Type of leasehold estate, which is terminable at will by landlord or tenant.
Tenancy at Sufferance (Holdover Tenant)
Arises when a tenant wrongfully remains in possession after expiration of tenancy.
Implied Warranty of Habitability
Implied in all leases of urban dwelling that the leased premises is and will remain fit for human habitation.
Retaliatory Eviction
Landlord cannot terminate a tenancy in retaliation for tenant exercising rights protected under the law related to housing.
Surrender
Mutual agreement between landlord and tenant terminating the lease.
Abandonment
Tenant abandons the premises before the expiration of the term of his tenancy.
Non Possesory interest in land +
Intrest in land that creates a right to use another’s land.
Contract Zoning
Contract with governing body to rezone the land to use in a particular way.
Floating Zone
A zone SPECIFIED in an ordinance together with permitted uses, but no land assignments.
Marketable Title
A title free from doubt that a reasonable prudent buyer would accept.
