Umbrella term for “any product of the human intellect that law protects from unauthorized use by others. Ownership of intell. prop. inherently creates a limited monopoly in the protected property.”
4 categories of intellectual property:
- Copyright
- patent
- trademark
- trade secrets

A federal law protecting authors of published and unpublished works from infringement by others.
Examples of authors of “original works of authorship” include:
Literary, dramatic, musical, artistic works
Intellectual works on OT - OT assessment, textbooks

A tangible piece of work. A tangible piece of work can be copyrighted
examples:
literary works, motion pictures, audiovisual works, assessment tools, originally created adaptive equipment, pictorial/graphic works etc
Key term
fair use
limited exception to copyright law allowing use of copyrighted materials in certain circumstances, such as: teaching, scholarship, research, or book reviews.
Four factors determine fair use:
- Purpose/character of use: non-profit or commercial
- Nature of copyrighted work
- Amount used in relation to the work as a whole: Using a small amount or a lot?
- Effect of use on potential market or value of work
