Umbrella term for “any product of the human intellect that law protects from unauthorized use by others. Ownership of intell. prop. inherently creates a limited monopoly in the protected property.”

A

limited exception to copyright law allowing use of copyrighted materials in certain circumstances, such as: teaching, scholarship, research, or book reviews.

Four factors determine fair use:

  1. Purpose/character of use: non-profit or commercial
  2. Nature of copyrighted work
  3. Amount used in relation to the work as a whole: Using a small amount or a lot?
  4. Effect of use on potential market or value of work
