What is the difference between Reinstatement, Re-establishment and Restoration?

A

Re-instatement (UK)/Re-establishment (EP) is rescuing an app where a DL has been missed and the app is treated as:
1. Refused
2. Withdrawn

Restoration is rescuing a patent, when the renewal fee due date and GP were missed

What about a request for restoration?

A

Yes, but only if the application itself has already been published
For restoration, all requests are published

In this case the request is published, the final decision allowing or refusing the request will also be advertised

Clue = who is the “directing mind”

A

The deciding mind the is the Proprietor’s not the agent. If the proprietor has never intended on killing the patent, the restoration should be granted

What is the last point at which a Proprietor can change their mind about paying RF?

A

In the last days of the extended period (Grace Period), a proprietor who had originally intended on not paying the RF can decide they actually would like to keep the patent alive and pay the RF late with additional fee.
