What is the Computer Misuse Act 1990?
A law that was passed to deal with problems of hacking, viruses etc.
What are the three levels of misuse?
- Tampering with data to be a nuisance
- Unauthorised access for criminal intent
- Unauthorised modification for criminal purposes
What are the conditions of the Computer Misuse Act 1990?
- Planting a virus
- Carrying out unauthorised work at your job
- Copying computer programs illegally
- Hacking
- Fraud
- Impairing/hindering data
What is the Data Protection Act 1998?
A law that allows data subjects to have access to info held about them & the ability to correct or delete it
What information must the data user provide before collecting the info?
- Reason
- Type of data they will store
- Who will have access (recipients)
- Who the info will be shared with (transfers)
- How the data will be collected
What are the 8 Principles of the Data Protection Act?
- Processed lawfully
- Specific purpose
- Adequate, relevant and not excessive
- Accurate & up to date
- Not kept longer than necessary
- Processed in accordance with data subject
- Held securely
- Not transferred outside of Europe
What are the exceptions for the Data Protection Act 1988?
- Payroll, pension, tax & accounts data
- Statistical/research data, e.g. census
- Crime & national security
What is the Personal Data Guardianship Code?
The PDGC is not a legal requirement but a guide for how businesses should deal with data, e.g. be accountable, make sure the data is always accessible & subject to review, subjects should be given as much control as possible etc.
What is the Copyright Design and Patents Act 1988?
A set of exclusive rights granted to the creator of original work, giving them the right to copy, distribute & adapt it
