Proving intent
Circumstantial evidence from which an offenders intent maybe inferred can include
Offenders actions and words before during and after the event
Surrounding circumstances
Nature of act itself
Statutory presumption 6(6)
A person in possession of a controlled drug for any of the purposes (1) c,d,e over specified amounts are considered to have possession for the purpose of supply unless they can prove otherwise
Rebuttal to presumption
If the person is able to prove on the balance of probabilities that they did not intend to commit a dealing offence
Eg heavily addicted and require large amount
Attempted possession
Offence to attempt to gain possession of a drug in the mistaken belief it is a drug
Eg thought it was cannabis but had purchased hedge clippings

Things a person has in his possession include anything subject to his control which is in the custody of another person
Eg storing drugs at a friends house
Actual possession
Actually has the drug in their control or custody

Meth 5 grams

Class B
Cannabis oil 5 grams
MDMA(ecstasy) 5 grams or 100 tablets

An agreement between 2 or more people to commit an offence (drug dealing)
Prove the defendant had something to do with the conspiracy in NZ to come within jurisdiction of NZ courts
