What are the three fraud offences?
- Fraud by false representation
- Fraud by failing to disclose information
- Fraud by abuse of position
Define fraud by false representation
- Def makes a false representation
- dishonestly;
- knowing it is false or misleading
- with the intent to make a gain for themselves or another;
- or to cause or risk a loss to another
What is a false representation?
A false or misleading statement as to fact, law or state of mind
Can a false representation only be made to a human?
No- can be made by a machine eg ATM, online, face-to-face, via agent
Can someone commit the offence of fraud by misrepresentation through recklessness?
No- they must actually know their representation is false or misleading.
This makes it a specific intent crime
Must a representation be untrue to be false?
No, it can also just be misleading
Define the offence of fraud by failing to disclose
- Def dishonestly fails to disclose to another person information;
- which they are under a legal duty to disclose;
- as they intend to make a gain for themselves or another;
- or to cause a loss/ risk a loss to another
Define the offence of fraud by abuse of power
- Def occupies a position where they are expected to safeguard the financial interests of another;
- and they dishonestly abuse this position;
- and intend to make a gain for themselves or another
- or to cause or risk a loss for another
Can abuse of position be committed by an omission?
Yes (e.g. failing to correct an impression)
Does the defendant need to know they occupy a position in which they are expected to safeguard the financial interests of another?
No
