What are MEES and what does it state the minimum EPC rating for a let building is?
Minimum Energy Efficiency Standards 2015.
Policed by the local authority.
Buildings must have a valid EPC minimum of E from 2018.
What MEES exemptions are there?
- The buildings is listed
- a place of worship
- industrial/workshops with low energy demand (no heating or cooling)
- where a tenancy is less than 6 months with no security of tenure
- temporary or buildings to be demolished
Exemptions must be pre-registered on the local authority private rented sector exemptions register and renewed give-yearly
Non-compliance penalties for MEES are policed by…?

What penalties are there for not meeting the MEES?
Commercial breach:
less than 3 months - up £5,000 fine or 10% of RV, whichever is greater. maximum penalty being £50,000.
more than 3 months - up to £10,000 or 20% of RV, whichever is greater. maximum being £150,000
What changes to MEES might happen?
September 2023 – Prime minister proposed to stop the change from raising MEES/EPC to Band C for new tenancies and by 2024 and all tenancies by 2028. This was shelved.
However, may be a new requirement for minimum requirement of B for new tenancies from 2030. No implementation plan yet available from government.
What is the purpose of MEES?
Ensure that rented properties meet a minimum level of energy efficiency. Currently, landlords cannot let commercial or residential properties with an EPC rating below ‘E’, unless an exemption applies. MEES aim to reduce carbon emissions, lower energy costs for tenants, and improve building efficiency.
