Affidavit
A statement Of facts reduced to writing, sworn to or affirmed before some officer, usually a notary public who is authorized to administer an oath.
Voir dire
The process of questioning prospective jurors to determine their qualifications and biases
Venire
A Panel of potential jurors
Law merchant
Medieval legal system established practice rules of commerce and trade
Where commercial enterprise has operated outside formal legal system.
Rules developed developed by merchants and business people to deal with each other.
Law relating to commerce was greatly influenced by law merchant
Appellant
The party who appeals from 1 quart to another
Answer
The pleading filed by the defendant responding to the plaintiffs complaint
Default
The failure of the defendant to file an answer which allows the court to enter a judgment for the plaintiff
Summons
A document issued by the court directing the defendant to appear in court or otherwise respond to the plaintiffs allegations
Peremptory Challenge
An objection raised by a party to a lawsuit rejecting a prospective juror for which no reason need be given for the objection
Directed vedict
A decision of the judge that the jury must decide as a matter of law in favor of one party and against the other
Complaint
The first pleading, a statement of the facts on which the plaintiff rest his or her case and file a lawsuit in court
Personal jurisdiction
The power of the court over the parties to the legal action
Appellee
The party against whom and it appeal is filed
Plaintiff
The party who files a claim in a court
Defendant
One who answers a complaint
