.4. Flashcards
Why do we need the law
To protect the weak
To be kept safe from criminals
To be able to live without fear
To give guidelines on acceptable behaviour
Justice (3)
Justice comes from the courts as they apply the law fairly
Justice is the process of allocating rewards or punishment and upholding what is right
There can be problems if a government passes a law which people think is unfair or unjust
Sin (3)
An action against the will of God
Some sins are also crimes e.g. Murder
Other sims such as adultery are not crimes
How are the laws made
The proposed law is written in a bill ➡️ debated in House of Commons ➡️ first reading ➡️ debated again ➡️ second reading ➡️ bill passed to a committee where it is reviewed again ➡️ passed to House of Lords ➡️ third reading ➡️ debate & vote on the bill ➡️ sent to queen for royal assent ➡️ becomes an act of parliament and is law .
Give as many arguments against theories of punishment as u can
Terence doesn’t work nearly half of all criminals reoffend and prisons are full
Retribution doesn’t always what somebody must be a criminal do you not get severity of punishment
In some serious crimes it is possible to argue that retribution is never cheap for the big Tim on the family
Reform is seen to go against punishment as it gives criminals more chances
Protection only works if criminals are in prison but many are released back into society
So my argue that there is a punishment do not focus on the causes of crime and there are a irrelevant
Also some punishments have a worse effect on the offenders families rather than the offender
Describe retribution in punishment
- makes criminals pay for what they have done wrong
- makes the victim feel a sense of justice
- the offender “got what they deserved”
Describe protection in punishment
The purpose of punishment is to protect society from violent or dangerous criminals
-keeping them in prisons means they can’t harm others
Describe deterrence in punishment
- discourages people from doing something again
- also seeing a punishment given may also put someone else of committing the same crime
Describe reform in punishment
Helps them see what they have done wrong
- reform means they won’t commit the crime again
- this could mean providing a criminal with education, skills or job training so they can become a law abiding citizen (rehabilitation)
