DEADLY FORCE is legally authorized by Nevada Revised Statute and Tennessee v. Garner (1985) to:

- Protect self or others from reasonably believed threat IMMINENT death or substantial bodily harm.
- Prevent the escape of a fleeing felon who officer has PROBABLE CAUSE committed a violent felony act and imminent threat to human life if escaped.

Officers will assess subject’s action(s) to determine use of force option to bring situation under control in a safe manner. Force applied in relation to the amount of resistance offered.
Subjects may be identified as:
- Compliant
- Obstructive
- Assaultive
- Life-Threatening
- Acknowledges direction or lawful orders; offers no resistance.
- Uncooperative, not complying. Physical actions are intended to prevent custody or control. Actions are not directed at harming the officer or others. LOW-LEVEL FORCE OPTIONS
- Subject demonstrates the intent to harm the officer or others. INTERMEDIATE FORCE
- Subject’s actions are likely to result in death or substantial injury. DEADLY FORCE
Elements of DEADLY FORCE are ABILITY, OPPORTUNITY, IMMINENT JEOPARDY, and PRECLUSION.
- The MEANS or capability, level of aggression or weapons in their immediate control.
- In POSITION to effectively resist an officer’s control or use violence.
- FACT and CIRCUMSTANCES subject poses an immediate threat to life MUST ACT IMMEDIATELY TO PREVENT DEATH OR SUBS’L INJURY
- Lesser alternative exhausted to include disengagement.
