~ must have an annual application submitted (45 days prior to the expiration) and approved by the Department
~ the Department will review background screening information for the individuals involved with the program
~ the owner must disclose if they have ever had a license denied, revoked, or suspended; or been subject of a disciplinary action or fined while working in a child care facility
- if yes, the licensing agency will review the information and determine if the license will be granted or not
~ if license is denied, the applicant has the right to appeal under Chapter 120 rights
~ the facility may not be used for any business or unrelated child care purposes or interferes with the program’s ability to comply with the licensing standards
~ cannot permit individuals who have not met the background screening standards or training requirements access when children are present, unless they are directly supervised
~ the facility operator must be at least 21 years old
~ there must be a staff person who is at least 21 years old in charge of the program on the premises at all times during operating hours
~ employees must be at least 16 years old to work independently
~ employees under 16 years old must be directly supervised at all times and excluded from the staff-to-child ratio
~ once licensed, refusal to dismiss child care personnel who have been found to be in noncompliance with personnel standards shall result in automatic denial or revocation of their license, in addition to other disciplinary actions
