S1 Computer misuse
He causes a computer to perform any function
With the intent to secure access to any program or data held in any computer to to enable such access to be secured
The access is unauthorised
And he knows that is the case at the time when he causes the computer to perform
What does securing access include?
Altering or erasing programmes or data
Copying it moving a program or data to a new storage medium
Using data for having it displayed or output in any form
What does unauthorised mean in regards to S1?
Neither entitled to control nor has the consent of the person entitled
S2 Computer misuse act?
Commits S1 with INTENT TO
Commit an offence to which this section applies
Facilitate the commission of such an offence now or futurewhere
The sentence is fixed by law
Or imprisonment for 5 years
S3 Computer misuse
He does any unauthorised act to a computer knowing his access is unauthorised
And intends/ or is reckless to
Importing the operation of the computer
Or
Preventing/hindering access to any program or data
Or
Impairing the operation of any program or reliability of such data
S32Z Computer misuse act?
Does any unauthorised act in relation to a computing knowing his access is unauthorised
The act causes or creates significant risk of serious damage of a material kind
They intend to do this or are reckless as to whether damage is caused
What is meant by damage of material kind?
Damage to human welfare
Damage to the environment
Damage to the economy of any country
Damage to the national security
What is classed as damage to human welfare?
Loss of human life Human injury or illness Disruption of supply of money food water energy or fuel Disruption of a system of communication Disruption of facilities for transport Disruption of health services
