221-03 (TRI Report):
What types of force don’t fall under this procedure because they don’t rise to a LvL 1 incident?(4):
1- ordering a person to lay on the ground or
2- guiding them to the ground in a controlled manner or
3- the use of Velcro straps or a polycarbonate shield to
4- restrain a subject is not a reportable use of force.
221-03 (TRI Report):
What types of force fall under a 1 level:
- hand strikes,
- foot strikes,
- Forcible take-downs,
- the wrestling of the subject to the ground,
- discharge of Oleoresin Capsicum (O.C.) pepper spray,
- the deployment of a (CEW) in “cartridge mode” or
- use of a mesh restraining blanket to secure a subject.

What types of force fall under a 2 Level:
- intentional striking of a person with any object
- a police canine bite,
- the use of a CEW in “drive stun mode.”
221-03 (TRI Report):
TRI will be filled out but a few stick out as weird, (3):
a. A subject or ANY NON-MEMBER sustains a physical injury or dies as a result of a police action or while in custody.
e. Any level of force, as described in this procedure is ALLEGED or suspected, whether or not an injury is sustained.
g. A member of the service discharges OC pepper spray, a Conducted Electrical Weapon or firearm, regardless of whether an injury was caused. (i.e., INCLUDES ACCIDENTAL DISCHARGES, DISCHARGES AGAINST ANIMALS, etc.).

If video evidence is available of the incident in which a TRI was prepared, it will be invoice as? if the supervisor needs help retrieving the video he should request the assistance of?
Note: invoice it as investigatory and request Boro investigations to assist in retrieving the video.

In what two situations would the immediate supervisor do Part A of the TRI report?
1- In situations where a person makes an allegation of force but the member claims that no force was used or
2- no member can be identified,
the IMMEDIATE SUPERVISOR of the member concerned will prepare PART A of the THREAT, RESISTANCE OR INJURY (T.R.I.) INCIDENT WORKSHEET.
221-03 (TRI Report):
If MOS is incapacitated who will fill out Part A?
7a. If member is incapacitated, complete PART A of the WORKSHEET using information known at the time.

The immediate supervisor will take photos as follows?
8b. Take digital photographs of visible injuries (relative to the incident) to subjects or any location where an injury is claimed, BUT NOT VISIBLE.

- Question Subject regarding possible injuries.
10. Question Involved Member regarding reasons for force used and type of force used.

The immediate supervisor will make an Active Log entry of details and inform who? of level of force used?
- Notify the DESK OFFICER, precinct/PSA/transit district of occurrence and level of force used and/or type of injury or illness.

Desk Officer will make an Command Log entry regarding the Incident and make sure whats included?
- Record details of incident in Command Log, including the Threat, Resistance or Injury (T.R.I.) incident number.

Desk Officer will notify who, if force level is a 2 or 3?
16 Notify the PATROL BOROUGH COMMAND, Operations Unit, and the Internal Affairs Bureau (obtain Internal Affairs Bureau log number), if a level 2 or 3 investigation is required.

The following incidents require a lvl 2-3
a. Level 2 or 3 force was used or suspected of being used
b. Subject or civilian sustained substantial or serious injury as a result of police action
c. Prisoner attempted or committed suicide
d. Suspected use of excessive force
e. Any person alleges that the force was excessive and a physical injury, substantial physical injury or serious physical injury was sustained.

In a Lvl 2,3 situation and the UMOS claims that he didn’t use force OR the UMOS can’t be identified, who will do Part A of the TRI report?
Note: the IMMEDIATE SUPERVISOR.

The investigative supervisor(CO/Duty) will prepare a TRI incident investigating supervisor ASSESSMENT report, once its entered into FORM and an Incident number is generated forward copies as follow:

c. Deputy Commissioner, Legal Matters
d. Deputy Commissioner, Training
e. Commanding Officer, Risk Management Bureau
