Define/identify the principles of justice.
When considering whether justice has been achieved in a particular case, we must consider the three principles of justice:
- Fairness
- Equality
- Access.
Define /explain one principle: Fairness.
Impartial and just treatment or behaviour without discrimination.
The accused should be able to:
- Case heard impartially/ objectively
- Understand the court processes
- Opportunity to present their defence
- Opportunity to rebut the prosecution’s case
The right to a fair trial or hearing is protected by the Charter of Human Rights and Responsibilities Act 2006 (Vic).
Define/explain one principle: Equality
The state of being equal, especially in status, rights or opportunities. No person or group should be treated advantageously (or disadvantageously) Free from bias, and impartial decisions. The Charter of Human Rights and Responsibilities Act 2006 (Vic) states that every Victorian is equal before the law.
Define/explain one principle: Access
Access to the criminal justice system means that all people should be able to understand their legal rights and pursue their cases. It also means being able to approach institutions that provide Legal advice, Education, and
Information and assistance. People need to be able to receive information about cases, processes and possible outcomes.
