Three Requirements of a Court-Martial
- Military Crime
- Military Accused
-Jurisdiction: must have jurisdiction over the crime AND the person - Convening Authority
Jurisdiction over Military Accused
- All active duty military personnel
- Reservists when offense was commited on active duty
- MIDN and Cadets
- Retired personnel receiving pay
- POWs
Jurisdiction applies everywhere
Court-Martial types
- Summary Courts-Martial (SCM)
- Special Courts-Martial (SPCM)
- General Courts-Martial (GCM)
Summary Courts-Martial (SCM)
Mega NJP
- All Commanding Officers
- NJP on steroids; punishments aren’t more severe, no jury, overseen by senior officer or JAG
Special Courts-Martial (SPCM)
Misdemeanors
- Battalion & Squadron COs (O-5 and above)
- Unit or activity in the Navy with an O-4 or above
- Similar to a misdemeanor; punishments are capped
General Courts-Martial (GCM)
Felony
- All FLAG Officers
- Limited number of O-6s
- Felony Court
What is Preferral?
The charge sheet is generated, sworn out, the CA signs off on it, and the Accused is served
Article 32
If a General Court Martial is appropriate
Independent JAG (O-4 or above) will review the evidence and decide if the case goes forward to trial
- Equivalent of a Grand Jury proceeding
- Accused actually gets to be there and put on a case if he/she wants
Package then goes to the GCMCA for review and next steps
What is a Referral?
If the GCMCA decides to go forward, the charges are “referred” to a GCM and Court-Martial is convened
Traits of a Military Trial
- Members and the judge get to ask witnesses questions
- Providency inquiry in uncontested trials
- Rules of evidence/objections
Members Panel
Determined by type of Court-Martial (CM)
- CA can pick potential members
- Accused elects whether or not to have members or to go “judge alone”

Courts-Martial CA Potential Post-Trial Actions
CA can:
- Disapprove a finding of guilty only for minor offenses
- Approve or reduce a court’s sentence, but can never increase the punishment
- Approve findings of not guilty
Accused has the right to request clemency from the CA
