**NOTE = statute CANNOT BE VAGUE (must allow sentencing body to consider all mitigating evidence)
can the death penalty be imposed for rape if the rape was neither intended to result in nor did result in death?
no
can prisoners who are insane at the time be executed?

yes, so long as they can still form a rational understanding of the reason for the death sentence

when it also involves imposition of a new sentence OR if rep is necessary to a fair hearing (ie–defendant denies violation)
**NOTE = defendant only entitled to counsel in cases where they were entitled to counsel at trial

when the regulation imposes an atypical and significant hardship (in relation to the ordinary incidents of prison life)

NO (no 4th amendment standing to challenge a search of their cells)
