Building Codes
These regulate building and construction standards that are regulated by state and municipal governments. These are designed to provide standards for the safety and welfare of the public.
Buffer Zone
A neutral zone that is created between conflicting zones. Often these areas can be landscaped and used for parks and playgrounds.
Certificate of Occupancy
The final permit given once construction is completed on a new build or remodel and is in compliance with zoning.
Cluster Zoning
This allows for buildings to be placed closer together to give the appearance of more open space. (A clover leaf)
Comprehensive Plan
This plan helps communities decide how areas should be developed or redeveloped and is implemented through zoning. This plan takes into account all properties.
Deed Restrictions
Real estate deed restrictions restrict the way in which a property, such as a house or condominium, can be used.
Density Zoning
How many houses can be built per acre of land.
Developer
This person buys the land from a subdivider and then makes improvements to is such as subdivision projects or large commercial properties.
Enabling Acts
Allow municipalities to carry out public use of land delegated by the state’s authority.
Interstate Land Sales Full Disclosure Act
A federal law that regulates the sale of unimproved land in interstate transactions. It allows buyers a 7 day decision period on the purchase of 25 or more parcels or lots less than 20 acres in size.
Nonconforming Use
A permitted use that was existing prior to current zoning, however, you are allowed to continue the use even though zoning has changed. (Grandfathering)
Restrictive Covenants
CC&R’s are private restrictions usually created by the subdivider/developer to enhance the value and enjoyment of the land by setting requirements.
Subdivider
This person buys undeveloped land and divides them into smaller parcels and sells them.
Variance
A permitted exception to current zoning. You must demonstrate unique circumstances that make the variance necessary.
Zoning Ordinances
Zoning ordinances are lengthy documents describing not only the acceptable use for specified areas of land, but also the procedures for handling infractions (including any penalties), granting variances and hearing appeals.
