Zoning Density
many rezoning requests are to increase the density of a zone to accomodate apartments etc.
Floor Area Ratio - limits on square feed regarding density
Why oppose higher density?
arguments about the impact on environment
impact on infrastructure - overcrowding of schools, roads, etc.
Government often requires parties to pay for infrastructure upgrates (sometime gov pays, developer, or owner of benefitted property)
Define Proffer
an offer where the developer offers to do something for the gov inreturn for a granted zoining request
Transfer of Development Rights (TDR)
may be transferred to adjacent property
What is a variance?
asking for an exception to the current zoning ordinance
Example: bbuilding a house that has a deck encroaching on setback line
What is a set-back line
area of property that you cannot build on
What is a comprehensive plan?
high level outline/description of how zoning should work in that particular area
What is vesting?
Once a zoning ordinance is issued, it is not finalized until the appeal process (for the losing party) is over
Vesting is the point in time where a developer has conducted substantial improvements and thus the ongoing project cannot be affected by rezoning
