Young Person
12- 17 years old at the time of offence
- can only charge 12 or older
- can arrest any age
*young person is still subject to same laws as adults - YCJA procedural how to deal with them
Declaration of Principles
- extra-judicial measure often the most appropriate and effective ways to address youth crime
- hold youth accountable for non-violent offence
- emphasize rehabilitation and reintegration
Custodial Portion
period of time that must be served in custody before they serve remainder under supervision in the community

Extrajudicial Measures
- measures other than judicial proceedings under this Act that are used to deal with a young person alleged to have committed an offence
- outside the court- no formal process
EJM Consideration
A police SHALL consider before starting any judicial proceedings or taking any other measures under this Act
- taking no further action
- a warning from the police
- a caution from police
- a referral from the police
- a crown caution
- an extrajudical sanction
Extrajudicial Sanctions
- more formal and most serious
- only used if police warning, caution, referral not enough, or seriousness of offence, previous offences
Notice to Parent
Upon Arrest or Detention
- peace officer SHALL as soon as possible give or cause to be given to a parent orally or in writing stating the reason
If Charged
- summons or appearance notice issuing officer will give notice in writing
- promise to appear or recognizance, the OIC will give notice in writing
