Withdrawal from the EU - introduction Flashcards
How was EU law given effect in the UK?
By the European Communities Act 1972 (ECA).
Upon withdrawal from the EU, what happened to the ECA?
It was repealed by the European Union (Withdrawal) Act 2018.
Why has the bulk of EU law been retained in the UK?
The bulk of EU law has been retained in order to avoid the chaos that would have ensued if it had all been repealed at the same time. This has been converted into domestic UK law by the Act and can be amended or repealed in virtually the same way as any other domestic law in the UK.
What is supremacy of EU law?
Where a conflict arises between EU law and national law of the MS, national law cannot override EU law. EU law must prevail over the offending national law instead.
