- Someone who gets financial benefit

A
- Be >18YO and of sound mind
2. Sound mind = capacity + free from undue influence + not subject to fraud

What is required for capacity?
A
When testator doesn’t know:
- Nature of the act;
- Nature and character of his property;
- Natural objects of his bounty; and
- Plan of the attempted disposition

What qualifies as an insane delusion sufficient to invalidate a will?
A
- Objective Test - insane delusion if rational person can’t reach same conclusion
- Causation - insance delusion is cause of testamentary position

What constitutes undue influence?
A
- Susceptibility - testator was susceptible to influence
- Motive - influencer has reason to benefit.
- Opportunity - influencer had opportunity to influence.
- Causation - influencer caused unnatural result
