S34 - Duty to Identify Hazards
A duty holder in managing risk to H/S must identify reasonably foreseeable hazards that could give rise to risk to H/S
S35 - Managing Risk to Health and Safety
A duty holder in managing risk to H/S must
a) eliminate risk to H/S sfairp
b) if not reasonably practicable to eliminate risk, then minimise risk afairp
S36 - Hierarchy of Control Measures
Duty holder must implement a combination of risk control measures
Substituting hazard for a lesser risk
Isolating the hazard from persons

S37 - Maintenance of Control Measures
A duty holder who implements a control measure to eliminate or minimise risk to health and safety must ensure the control measure is and is maintained so that it remains effective.
Control measure must remain:
- fit for purpose
- suitable for the nature and duration of the work
- installed, setup and used correctly.
S38 - Review of Control Measures
A duty holder must review, and as necessary revise control measures implemented under a regulation so as to maintain afairp a work environment that is without risk to H/S.
- a control measure does not control the risk it was intended to control
- before a change at the workplace (environment, work, process, procedure) that is likely to give rise to a new or different risk to H/S that the measure may not effectively control
- a new relevant hazard or risk is identified
- consultation indicates a review is necessary
- H/S representative requests a review
S39 - Provision of Information / Training / Instruction
- Primary duty of care
- PCBU must ensure Information / Training / Instruction is provided to a worker is suitable and adequate for:
- nature of work
- nature of risk associated with work
- control measures implemented
Must be provided in a way that is readily understandable by any person
S43 Duty to prepare / Maintain and Implement Emergency Plan
PCBU must ensure an ER Plan is prepared that provides:
a)Emergency Procedures
- effective response to emergency
- evacuation procedures
- notify ER services
- medical treatment and assistance
- Effective communication to coordinate response
b) Testing of ER procedures, including frequency
c) Information/Training/Instruction to relevant workers
PCBU must maintain ER plan so it is effective
PCBU must implement ER plan in event
PCBU must have regard for:
- nature of work
- nature of hazards
- size and location of workplace
-number of persons at workplace
