Why is there concern about Judicial review interfering with parliamentary sovereignty ?

A

Concerns surrounding the expansion of the Judicial review powers, particularly through the incorporation of the European Convention on Human Rights into UK law via Human Rights Act 1998.
Some MPs (Ian Duncan Smith) are concerned that the Judiciary can invalidate acts of parliament.

Why could the interpretation that Judicial review is disrupting Parliamentary sovereignty be invalid?

A

The UK supreme court cannot strike down legislation passed by the UK parliament. The HRA only gives it the power to interpret and rewrite legislation if it aligns with the original legislation.

Prime Minister and cabinet hold significant influence in HoC often at the expense of parliamentary scrutiny and accountability.
If parliamentary scrutiny cannot happen effectively parliament is not truly sovereign.
