Defending themselves of others (S48). Fear GBH or death, and cannot reasonable protect themselves or others in a less violent manner.

Arresting an offender.

• Believe on reasonable grounds the offender poses a threat of death/GBH in resisting their arrest.
• Arrest cannot be reasonable effected in a less violent manner.
• The arrest cannot be delayed without danger to other people (S39)

• Believe on reasonable grounds that the offender poses a threat of death/GBH to any person AND
• the offender less to avoid arrest or escapes after their arrest AND
• The flight or escape cannot reasonably be prevented in a less violent manner (40)
