What must the defendant comminted to be charged with voluntary manslaughter

A

Have committed the actus reus (of murder), have mens rea (of murder) and there must be a causal link between the D’s acts and the death, and mitigating circumstances ( that mean the charge of murder is reduced to voluntary manslaughter).

A

Unless directed to, you are not required to prove murder in order to use one or two of the types of voluntary manslaughter. They are partial defences and you will be directed to advise whether a person can avoid liability for murder by using one of the two partial defences.
