What are your powers to obtain information under section 176 and your remedies for non-compliance?
Section 176(1)-(3)
When a police member has reasonable cause to suspect anyone has/is/is attempting to commit
Any offence against this act
They may demand NAME, ADDRESS, DOB
If the officer has a belief on reasonable grounds that the particulars are false, they may demand evidence of particulars.
If the person fails or refuses to give any particulars or evidence when demanded they shall be WARNED, if they persist they may be arrested.
Identify the powers of entry onto licensed premises found in section 175 of the Sale of Liquor Act 1989.
Section 175(1) & (2) Any member of police may At any reasonable time OR at any time Enter and or inspect licensed premises To ascertain if the licensee or manger is complying with the licence OR they have RGTB at any time that an offence is being committed on those premises
What are the conditions under which police are able to order the temporary closure of licensed premises?
Riot or fighting or serious disorder.
