What is the test in the modern day for vicarious liability?
Not a specific test but courts will examine concrete, tangible factors such as financial risk, degree of responsibility etc
What is vicarious liability?
Blameless employer is liable for a wrong committed by the employee in the course of employment

The tort must have been committed whilst acting in the course of employment.
What is the economic reality test?
regardless of how the parties have classified their relationship, courts examine the reality of working relationships; even written terms in contract are not conclusive
