Liability that a supervisory party (such as an employer) bears for the actionable conduct of a subordinate or associate (such as an employee) based on the relationship between the two parties.
Vicarious Liability
The participants in a business undertaking by two or more persons engaged in a single defined project. The necessary elements of the joint venture are (1) an express or implied agreement; (2) a common purpose that the group intends to carry out; (3) shared profits and losses; and (4) each member’s equal voice in controlling the project.
Joint Venturers
The doctrine by which an employer may be held liable for the tortious acts of an employee under their charge if the employee was acting in the scope of employment.
Respondeat Superior
The range of reasonable and foreseeable activities that an employee engages in while carrying out the employer’s business; the field of action in which a servant is authorized to act in the matter-servant relationship.
Scope of Employment
