14 USC 89 A
The Coast Guard may make inquires, examinations, inspections, searches, seizures, and arrests upon the high seas and waters over which the United States has jurisdiction, for the prevention, detection and suppression of violations of laws of the United States.
For such purposes, commissioned, warrant and petty officers may at anytime go onboard any vessel subject to the jurisdiction or to the operation of any law of the United States, address inquiries to those onboard, examine the ship’s documents and papers and examine, inspect and search the vessel, and use all necessary force to compel compliance.
FRISK
The crushing and passing of hands over the outer clothing of a person in search of weapons, when the officer suspects an individual may have a weapon that poses a threat to the boarding team or others.
SEARCH
An entry or intrusion by a government agent on a quest for evidence into an area where an individual has a reasonable expectation of privacy.
REASONABLE SUSPICION
The belief by a reasonable and prudent person based on articulable facts, that something has happened.
PROBABLE CAUSE
The level of suspicion that would cause a reasonable and prudent person, given the overall circumstances to believe a crime has been or is being committed.
SERIOUS PHYSICAL INJURY
Actual physical injury to the body that results in (a) unconsciousness; (b) protracted and obvious disfigurement; or (c) protracted loss or impairment of the of the function of a bodily member, organ or mantel faculty.
USE OF FORCE GUIDING PRINCIPLE
Only that force reasonably necessary under the circumstances may be used. Force shall not be used where assigned duties can be discharged without it. Excessive force may never be used; however, nothing in the application of the Coast Guards use of force policy shall be construed as to require personnel to meet force with equal or lesser force.
LEVEL 1: OFFICER PRESENCE
Officer presence is the appearance, demeanor, and verbal and non- verbal communication that creates an atmosphere of compliance.
LEVEL 2: VERBAL COMMANDS
Verbal Commands are in the form of task direction with consequences aimed at the subject
LEVEL 3: CONTROL TECHNIQUES
Control techniques are techniques and actions with a low probability of causing connective tissue damage, lacerations to the skin or broken bones. These techniques include the proper use of restraint devices, pain compliance and strength techniques
LEVEL 4: AGGRESSIVE RESPONSE TECHNIQUES
Aggressive response techniques are techniques and actions that are likely to result in connective tissue damage, lacerations to the skin and or broken bones and irritation of the skin, eyes and or mucous membranes. These techniques include; kicks, stuns, punches, takedowns and chemical irritants.
LEVEL 5; INTERMEDIATE WEAPONS
Intermediate weapons are techniques and actions with a high probability of causing connective tissue damage, lacerations of the skin and or broken bronzes. These techniques include the proper use of an expandable baton and authorized less than lethal technologies.
LEVEL 6: DEADLY FORCE
Deadly Force is any force that is likely to cause death or serious physical injury
PASSIVE COMPLIANT
A subject who follows the officers requests or verbal directions
PASSIVE RESISTOR
A subject who does not follow the officers request or verbal direction but offers no physical resistance to the officers attempt to gain control
