Federal Venue is Proper In a District IF Either
Any defendant resides; if all defendants reside in that same state OR any substantial part of claim arose OR where property at issue is located
Oregon Venue is Proper in a County Where Either
Any defendant resides (organization resides where it does business/has offices/where has agent) OR cause of action arose
Exception to Oregon Venue
If no defendant resides in Oregon, venue becomes proper in any county.
An action involving land, venue is proper only where land is located.
Objections to Improper Venue
File motion to transfer venue, will be granted at Court’s discretion for coniveience of parties and witnesses and interest of justice.
Oregon Specific Objections to Improper Venue
Motio must be filed before the answer if filed AND must contain an affidavit that venue is improper.
