A

  1. There is probable cause that the suspect had committed a felony involving the use or threatened use of deadly force AND;
  2. The suspect is armed or otherwise posed and imminent threat of death or serious physical injury to any person AND;
  3. The suspect had failed to obey an order to halt (such order shall be given if feasible and would not increase the danger to the officer or others).
