Federalism
Constitutional arrangement whereby power is distrubuted between a central gov’t and subdivisional gov’ts, called states in the U.S. The nat. and sub. gov’ts exercise direct authority over individuals.
Dual Federalisim.
The view that the Constitution give a limited list of powers to the nat. gov’t.
Cooperative Federalism
The view that federalism is a system of intergovernmental relations and requires cooperation among various levels of gov’t.
Regulated Federalism
a form of federalism in which Congress imposes legislation on states and localities, requiring them to meet national standards.
Express Powers
Powers specifically granted to one of the branches of the national government by the constitution.
Implied Powers
Powers inferred from the express powers that allow congress to carry out its functions.
Inherent Powers
The powers of the nat. gov’t in the field of foreign affairs that the Supreme Court has declared do not depend on constitutional grants but rather grow out of the very existance of the national gov’t.
Necessary and proper clause
Clause of the constitution setting fourth the implied powers of Congress. It states that Congress, in addition to its express powers, has the right to make all laws necessary and proper for carrying out all powers vested by the constitution in nat. gov’t.
Commerence clause
The clause in the constitution that gives Congress the power to regulate all business activities that cross state lines or affect more than one state or other nations.
Federal Mandates
A requirement imposed by the federal gov’t as a condition for the receipt of federal funds.
Full faith and credit clause
Clause in the Constitution requiring each state to recognize the civil judgements rendered by the courts of other states and to accept their public records and acts as valid.
Centralists
People who favor national action over state action.
Decentralists
People who favor state action over national action.
Block Grant
Broad grants to states for perscribed activities. Welfare, child care, education, social services, health care, with few strings attached.
Devolution Evolution
Effort to slow the growth of the federal gov’t by returning many functions to the states.
