In an insurance claim who is held to be which parties?
Insurance company - first party
User of the motor vehicle - second
Person injured or whose property is damaged - third party
Give an example of someone who may not be an owner or registered keeper of the vehicle they are driving?
Delivery driver - company (owners) owns delivery vehicles, subsidiary depot are allocated some (registered keepers), the subsidiary depot employs drivers who use them
What must a keeper do if they wish to keep a vehicle but not insure it?
They must remove the vehicle from the road/public places, inform the DVLA and complete a Statutory Off-Road Notice (SORN). If not subject to SORN, offence under s.144A RTA
What is the defence for S.143 (driving without insurance)?
If all of the following apply:
1. Vehicle did not belong to the driver
2. Vehicle was not hired to the driver
3. Vehicle driven in course of employment
4. Person neither knew nor had reason to believe there was no insurance
What are the 4 exemptions from requiring insurance?
- Vehicles owned by the crown
- Local authorities
- Police
- Vehicle driven for police purposes or under instruction of a constable (commandeering)
When do police have the power to require the production of a certificate of insurance?
From any person who:
- is driving a motor vehicle on a road, or
- suspected of driving in a collision
- committed a road offence
With a HO/RT1, how many days do they have to produce the necessary documents?
7, starting on the day after the requirement was made
When may a person not be prosecuted for failing to produce the necessary documents (HO/RT1) within the 7 days?
Returning from a holiday lasting longer than 7 days
Securing documents from a company hq
Producing driving license on its return from DVLA
Do insurance or test certificates have to be produced in person?
No, they can be produced by a friend or relative on behalf
Can you seize a vehicle if someone is driving without insurance or license?
Yessssss (only for motor vehicles being driven on a road)
If a vehicle has failed to stop or has driven off, what timeframe do you have to seize the vehicle?
24hrs
In relation to seizure of a vehicle, where can you enter?
No power to enter private dwelling, but can enter any garage, other structure occupied within the dwelling house, or any land adjoining (gardens, driveways)
