Civil Liberties

Establishment
The government cannot establish a state religion (Lee v. Weismann; schools cannot force students to engage in prayer)
Civil Liberties in the Bill of Rights
Civil liberties are outlined in the bill of rights (1st 10 amendments)
The role of the Supreme Court in interpreting civil liberties
the Supreme Court interprets the Constitution and the Bill of Rights. They decide when the government has violated your civil liberties through judicial review
Judicial Review
The judiciary determines when the government has crossed the line established by the Bill of Rights through judicial review
Incorporation
Process of applying an amendment to the states so that it protects people from state/local governments infringing on their rights/liberties
Freedom of Expression
congress can make no law respecting the law of religion or prohibiting the free exercise thereof; or abridging the freedom of speech
Free Exercise
The government cannot restrict your right to practice religion
Freedom of Privacy
3rd, 4th, 5th, 9th, and 14th Amendment; an implied right
Due Process
fair treatment through the normal judicial system, especially as a citizen’s entitlement.
Property Rights
the rights individuals or firms have to the exclusive use of their property, including the right to buy or sell it
