Civil Rights
Granted by the legislature, protect equality
Civil Liberties
Natural, protected by the constitution, protect individual freedoms
Establishment Clause (1st Amendment)
The government cannot establish a religion
Free Exercise Clause (1st Amendment)
The government cannot block free exercise of religion
Time, place, and manner restrictions
The government may ban speech for certain times, places, or in certain manners to uphold public order
Defamation
Speech that damages the reputation of someone
Clear and present danger
Speech may be prohibited if it poses a clear and present danger to public safety
Prior restraint (1st amendment)
Suppression of material or publications that may be harmful or false
Selective Incorporation
SCOTUS application of the bill of rights to states one piece at a time
Due Process Clauses (5th and 14th Amendments)
5th amendment: applies to national government
14th amendment: applies to states
Enumerated Rights
Rights protected by specific clauses in the constitution
Unenumerated Rights
Rights not written in the constitution, but are implied
Equal Protection Clause (14th Amendment)
Requires states to practice equal application of laws to all people

The largest group decides policy
Minority Rights
The largest group cannot enact policy that harms minority groups
