What are the types of discrimination?

A
  1. Harassment: it is verbal or physical attacks on a person becuz of a group they belong to
  2. Unofficial discrimination: people, groups, or organizations discriminating against people despite laws against it
  3. Systemic discrimination: discrimination supported by the government and laws it has passed
  4. Segregation: when members of certain groups are forced to live, work and go to school away from society
  5. Expulsion: when members of a certain group are completely expelled from society
  6. Genocide: killing of members of a certain group simply becuz they are part of that group

What is stereotyping and discrimination?

A

Stereotyping is when there is a fixed mental image of physical appearances or characteristics of individuals based on the group they belong to

Ex: smart people are nerds, Canadians are nice

Discrimination is when you actively support or start one of the 6 different kinds of discrimination to expel a certain group for no reason other than you dislike them.

Ex: racism, Asian hate

What is the evolution of the charter?

A
  1. English common law inherited from the UK and the parliamentary branch is the highest political and law making body in the country
  2. The Canadian bill of rights came after in 1960 which gave Canadians protection from the government and was a reminder to Canadians of the rights they had, it was the precursor to the charter but had many limitations. Prime minister diefenbaker introduced legislation which birthed the bill of rights.
  3. The Victoria charter came after in 1971 with pierre Trudeau wanted changes to the constitution. It was held in Victoria BC with provincial premiers, anglophone provinces wanted an amending formula and patriation from the UK. Quebec wanted autonomy however no agreement was made becuz they would not agree to any terms. In 1980 a compromise was made for the charter with the exception of Quebec.
  4. Finally the charter of rights and freedoms was made which is believed to be the most important part of our constitution. It included the reasonable limits clause which indicated the limit must be important and for the benefit of society as a whole, greater than the harm and the law must interfere as little as possible to that freedom or right.

Constitution and how it came to be

A

The BNA Act: basic structure for Canadas system of government.

Unwritten set of rules and conventions: rules and conventions that our government operates by but isn’t written.

  1. Court rulings: interpret constitution and become precedent used for other cases.
