What are rights?
These are something which a person is morally or legally entitled to.
What are responsibilities?
These are things that you are accountable for and are always in conjunction with a right.
Give 2 examples of rights.
Right to safety, education
Name 1 responsibility we have.
The responsibility to treat others with respect because we all have the right to be treated with dignity.
What does the Charter of Rights and Freedoms do?
It protects individuals against arbitrary action of the government and their agencies.
What is the constitution?
It is Canada’s Supreme Law.
Why is the constitution important?
It’s important because laws which are inconsistent with it will be considered illegal. It also contains the Charter.
What happens if a law does not follow the provisions of the Charter?
The parliament must rewrite the law or it will be thrown out.
What year was the Cdn. Constitution changed?
1982
What are 3 major changes that occurred in the constitution.
- Future changes can be made without UK’s permission
- Declaration Act of the Cdn. Const. Act is Canada’s Supreme Law - inconsistent laws with it are illegal.
- Charter was added.
What does Section 15 of the Charter look at and why’s this section important?
This sections is about Equality Rights. It is important because it prevents discrimination and keeps peace despite our difference.
What are differences between the Ontario Human Rights Code and the Charter?
The OHRC deals with how we the people treat each other whereas the Charter deals with how we interact with the government.
Why can teachers/admin do locker searches when this conflicts with the Charter?
Everyone is also guaranteed safety, so a locker search may be conducted if there is a potential threat to safety.
