What is the name of the legislation that consolidated the regulation of medicine for human use?
Human medicine regulation 2012, there are still some parts of the medicine act 1968 that are active.
Who can write prescriptions?
Uk registered doctors, dentists, nurse independent prescribers, pharmacist independent prescribers, optometrist independent prescribers, veterinary surgeons/practitioners,supplementary prescribers, podiatrist or physiotherapist independent prescribers, EEA or Swiss (Drs dentists prescribing pharmacists or prescribing nurses)
What are PO medicines?
A product that is licensed as a GSL but which the manufacturer wishes to restrict sale to pharmacies.
Can GSL medicines be sold when there is no pharmacist present?
If it is a non pharmacy premise they can be sold at any time.
In a pharmacy there has to be a responsible pharmacist although they do no physically have to be present.
What are the restrictions on products containing pseudoephedrine and ephedrine?
The maximum pseudoephedrine that can be sold is 720mg.
The maximum ephedrine that can be sold is 180mg.
It is illegal to sell a combination of the above two API in ANY quantity.
What is the maximum quantity of paracetamol or aspirin that can be sold?
No more than 100 non-effervescent tablets.
There is no restriction on effervescent tablets, powders, liquids or granules.
What details are LEGAL REQUIREMENTS for general prescription details, not including any drug details?
Must be signed by the prescriber
Must have the prescribers details IE type of prescriber and address
Must have a date which the prescription was signed on
Must have name of patient
Must have address of patient( unless EEA or Swiss prescribers)
Must have the age of the patient IF under 12
Must be in indelible ink
What are repeatable prescription regulations?
NHS prescriptions not repeatable, FRPS/CMS separate from repeats.
Schedual 2 and 3 drugs are not repeatable.
Schedule 4 and 5 drugs may be repeated.
Prescriptions are repeated as detailed on prescription.
If number of repeats is not specified it is repeatable once only, unless it for oral contraceptives which can be dispensed a total of six times.
For repeat prescriptions, including schedule 5 drugs the first repeat must be within 6 months, whereafter the remaining repeats have no legal limit.
For schedule 4 drugs the first repeat must be within 28 days, whereafter there are no limits for the remaining repeats.
If a patient wishes to take a repeatable prescription elsewhere, what should be done with the prescription?
The prescription should be marked with the date, name and address of the pharmacy where the supply has been made.
What are the legal time limits for when balances on non repeat prescriptions must be made?
POM, P, GSL and cd-5 - 6 months from date on prescription
Schedule 2, 3 and 4 cd - 28 days from appropriate date.
How long must records be kept for private prescriptions and what should be recorded? When should this be recorded?
Two years from sale or supply or two years from last dispense for repeat prescriptions.
Supply date, prescription date, medicine details, prescriber details and patient details should all be recorded.
This must be recorded on the date of supply or the following day only.
Records do not have to be made for oral contraceptives.
Schedule 2 drugs only need to be recorded if they are not recorded in a cd register.
What details of medicine must be presence on a prescription legally?
Details of the medicinal product such as name, strength,form, quantity or dose are not legal requirements. These are clearly needed and if there is any uncertainty about medication the prescriber should be contacted.
Are faxed prescriptions legal?
No, although they can be used but at considerable risk. Alternative methods should be used if possible.
What restrictions are there on dental prescriptions?
Legally they can prescribe any POM, however they should restrict their prescribing to areas in which they are competent, and generally they only prescribe medications which are used in dentistry.
If prescribing on NHS, dentists are restricted to medicines listed in the dental prescribers formulary, and cannot prescribe brands.
What regulations are there for prescriptions from EAA or Switzerland prescribers?
Dr, dentist and prescribing nurse and pharmacist are legal.
It is also legal to give patients from these countries emergency supplies, where the prescription must be received within 72 hrs.
The prescription must contain:
patient name and DOB
prescribers full name, qualification, contact details and address
Prescribed medicine details including name of medicine, form,quantity,strength and dosage
Signature of prescriber
Date of issue - legal dates are the same as uk prescriptions.
Cd 1, 2 and 3 are not allowed.
