Human Rights
basic moral or legal entitlements that exist for all human beings irrespective of any personal qualities or characteristics
International declarations
non-binding agreement that sets out aspirations or intentions of countries (or international orgs) who are party to it
International treaties
legally binding agreements between countries (or international org) in which they undertake the obligations set out in the agreement and implement them in domestic life.
UDHR
-adopted by all 192 UN member states
-has lead to creation of 80+ international treaties
HR protections via statute law
-created by state and federal parliaments eg
Racial Discrimination Act 1975 Cth + Equal Opportunity Act 2010
-can make exemptions to general principles against discrimination
Victorian Charter of Human Rights and Responsibilities
-recognizes basics rights, freedoms, responsibilities of Victorians
-Mps must make Statements of Compatibility when intro new legislation
-imposes obligations on public authorities to act w/ HR in mind
-Supreme Court can declare law X consistent w/ HR but X strike it down
