What is common law in Canada?
A
Common law is a body of law that continually develops as it is created by court decisions that becomes judicial precedent. It is law that was not created by parliament.
When there is no statue law law to govern the matter the court looks upon common law for a resolution

What is statue law in Canada?
A
- The laws which are created by elected representatives in the federal Parliament or a provincial Legislative Assembly are usually called “acts” or “statutes

What is private law in Canada?
A
- Private law sets the rules between individuals. It is also called civil law. Private law settles disputes among groups of people and compensates victims, as in the example of the fence.
- Examples: family law, estate law

A
- public law structures the legal relationships between individuals and the state and between different institutions within the state.
