S12 – TWOC
A
- Without consent of the owner, he takes a conveyance for his own/another’s use or knowing that any conveyance has been taken without consent, drives or allows himself to be carried in it.
- Hire car – TWOC form the person who it is hiring the vehicle at the time not the rental company
- Does not include towed vehicles i.e: car park.
- Have to be in the car – cannot abandon it.
- Must be a degree of movement
• ‘conveyance’ – constructed or adapted for the carriage of a person or persons whether by land, water or air.
• Doesn’t include anything constructed or adapted for carrying items other than people e.g. pedestrian controlled trolleys used by postal workers.
• Pedal cycles are not included under this legislation

S12A – Aggravated TWOC-
A
- Veh being driver dangerously on a road/public place
- Due to the driving of it, an accident occurred where injury was caused to anyone or damage was caused to any other property; or
- Damage was caused to the veh, after being taken.
