What exceptions does TRIPS allow from National Treatment?

A

Exceptions already provided in, respectively, the Paris Convention (1967), the Berne Convention (1971), the Rome Convention or the Treaty on Intellectual Property in Respect of Integrated Circuits.

Only where such exceptions are necessary to secure compliance with laws and regulations which are not inconsistent with the provisions of this Agreement and where such practices are not applied in a manner which would constitute a disguised restriction on trade.

A

Art 13 TRIPS - must be confined to special cases, not conflict with normal exploitation of the work; and not unreasonably prejudice the legitimate interests of the rights hold (US-Section 110(5) Copyright Act).

TRIPS Art 20 - how does this effect trademark rights?

A

TRIPS Art 20 disallows ‘unjustifiable encumbrances’ on trademarks by means of special requirements (e.g. requiring use with another trademark or in special form).

Note - must be unjustifiable - health warnings, etc, may be justifiable.

What are the requirements for GIs under TRIPS?

A

Art 22.1 - members must protect GIs which identify a good as originating in the territory of a Member, or region/locality, where a given quality, reputation or other characteristic of the good is essentially attributable to its geographical origin.

What protection does TRIPS afford to GIs?

A

Art 22.2 - Members must provide legal means to prevent use of designation/presentation of good that misleads public as to geographical origin of the good; and use that constitutes unfair competition under Paris Convention (art 10bis).

Art 23 - provides enhanced protection for wines and spirits.
