Tort
breach of some obligation, harm or injury to someone; civil wrong such as negligence
Judgement
court’s decision in a civil case
Damages
money asked for or paid by court order to a plaintiff for injuries or losses suffered
Liability
legal responsibility, obligation to do or not do something
Remedy
what is done to compensate for an injury/enforce right
Settlement
agreement made by both sides in a civil suit. made either before the case goes to trial or final judgement made. settles or ends dispute
Common Law
Law established by the court system
Precedent
appellate court decision on a legal question that guides future cases; single issue of common law
Statute
written laws enacted by legislators; law made in congress
Intentional Wrong
action to deliberately harm another person and/or their property
Negligence
failure to exercise reasonable amount of care in either doing/not doing something, resulting in harm to someone
Strict Liability
legal responsibility for damage/injury even if you aren’t negligent
Civil Law
all law that doesn’t involve criminal matters. Ex: Tort and contract law
Deep Pockets
description of a person/organization best able to pay damages. most likely to be sued
Immune
exempt from penalties, payments, and legal requirements; free from prosecution
