Must the defence provide details of it’s witnesses to the prosecution?
Yes, details of defence witnesses must be served to the prosecution.
The names, addresses and dates of birth of any other witnesses must be served on the Prosecution.
What does an s9 witness statement require?
Requires either party to serve copies of statements in the correct form that they wish to agree with the other party can be read.
What is the position of defence disclosure after a not guilty plea at the PTPH
The defence must provide a defence statement, setting out the nature of the defence, including any particular defences on which the Defendant intends to rely.
When can a spouse on the accused be compelled to give evidence against the accused?
If they are committed of a specific offence which includes sexual offences of someone younger than 16.
What type of questions are allowed during examination in-chief (own witness, first call up)?
Non-leading, open questions
