A

What is a taking control of goods orders?

A

Allows a defendant’s goods or assets to be seized then sold at auction to pay the debt owed to the claimant. Only suitable if the defendant has own assets that are moveable and can be picked up by an enforcement officer and sold. The claimant must apply for a writ of control (high court - over £5000) or warrant of control (county court under £600) (either if in between)

What is a third party debt order?

A

An order made against a third party, such as a bank or trade debtor, to pay the debt owed by the defendant. If the defendant had in their sole name savings that covered the amount the claimant could apply (cannot be a joint account)

What is a charging order?

A

It effectively secures the amount of the judgment debt against land held by the defendant. If the claimant is granted a charging order this means when the defendant comes to sell the asset the judgment debt will be paid to the claimant out of the proceeds of sale

What is an attachment of earnings order?

A

Only available through the county court and only applicable where the defendant is employed (not self-employed). If granted, it requires the defendant’s employer to pay a specific sum from the defendant’s wages directly to the court which then passes this to the claimant until the debt is paid
