Define (AT NIGHT)
– means from half an hour after sunset until half an hour before sunrise, or such
other period for the lighting of vehicles as shall be fixed from time to time by the
Commissioner of Police and published in the Gazette.
Define (DRIVER)
driver” includes any person actually driving a motor vehicle at any given time
and any person in charge thereof for the purpose of driving whenever the same is stationary
on any road.
Define (TARE)
means the actual weight of a motor vehicle when not laden but inclusive of the
body, accumulators, loose tools, spare wheels, and other usual equipment and a full supply
of water and fuel used for the purpose of propulsion.
Define MAXIMUM GROSS WEIGHT
– or M.G.W. in reference to a goods vehicle means the
tare together with the load including the weight of the driver and the loaders, and in reference
to a motor omnibus means the tare together with the weight of the driver, conductor and
number of passengers for which the vehicle is registered; and for the purposes of this
definition the weight of a driver, loader, conductor or passenger shall be taken as sixty (60)
kilograms.
Define (MAXI TAXI)
means a public service vehicle with seating accommodation for no fewer
than nine or more than twenty-five passenger
Define MOTOR VEHICLE
means any mechanically propelled vehicle intended or adapted for
use on roads and includes a trolley vehicle, but does not include vehicles constructed
exclusively for use on rails or other specially prepared tracks.
Define (OWNER)
a) in the case of a motor vehicle that is not registered, includes the person in actual charge
or possession of the vehicle in Trinidad and Tobago;
h) in the case of a vehicle that is registered, means the person in whose name the vehicle is
registered:
Provided that, in the case of a motor vehicle which is the subject of a hire purchase agreement,
it means the person in possession of the vehicle under that agreement; and whenever the
registered owner of a motor vehicle is absent from Trinidad and Tobago, the person in actual
charge or possession of the vehicle in Trinidad and Tobago shall be deemed to be the owner.
Define PARKING and the exception of parking
means causing or permitting a vehicle, whether occupied or not, to stand in a road,
except –
(h) (i) while the vehicle is being loaded or unloaded; or
while passengers are entering or leaving the vehicle; or

(j) in compliance with the directions of a constable or of a traffic sign or with the
requirements of traffic regulations; or
(k) while temporarily stopped by reason of traffic conditions; or
(l) while stopped owing to mechanical breakdown or lack of fuel,
and “park” and other cognate expressions shall be construed accordingly.
Define (DEALERS’ GENERAL LICENCE)
This is a permit that authorizes a person or company or firm
in the trade to purchase vehicles or trailers that are brought into the country for resale. The Dealers
General Licence permits the owner to have the vehicle on the roadway/highway even though the
vehicle is not registered as yet but under certain conditions.

Powers of police where vehicle is parked in contravention of Act or left on road
(1) Where a vehicle is parked in contravention of any provisions of this Act or of any
regulations or orders made thereunder, or is left on any road in such a manner that it is likely to cause
any obstruction to persons lawfully using any such road, any member of the Police Service may—
❖ require the driver or other person in control or in charge of the vehicle to remove such vehicle
or cause it to be removed, and any such person who fails to comply with any such requirement
is liable to a sum of three hundred dollars ($300.00) or to imprisonment for three (3) months;
❖ if the driver or other person in control or in charge of the such vehicle cannot be found or
refuses to remove it when required to do so, remove such vehicle or arrange for it to be
removed from the place in which it is parked to a place of safe custody either by towing or
driving the vehicle or in such manner as he may think necessary.
Define TRAFFIC
includes bicycles, tricycles, motor vehicles, tramcars, and vehicles of every
description, pedestrians and all animals being ridden, driven or led.
Charges payable before delivery of vehicle and sale of vehicles in custody
(1) Where a vehicle is parked in contravention of any provisions of this Act or of any
regulations or orders made thereunder, or is left on any road in such a manner that it is likely to cause
any obstruction to persons lawfully using any such road, any member of the Police Service may—
❖ require the driver or other person in control or in charge of the vehicle to remove such vehicle
or cause it to be removed, and any such person who fails to comply with any such requirement
is liable to a sum of three hundred dollars ($300.00) or to imprisonment for three (3) months;
❖ if the driver or other person in control or in charge of the such vehicle cannot be found or

Define STOP LINE
means any line painted on, or made of metal or other suitable material
placed on a road for indicating where traffic must stop when required to do so either by a
constable engaged in the control of traffic or by a traffic sign or by a light signal.
Define vehicle
VEHICLE – includes tramcars, carriages, wagons, carts, motor vehicles, bicycles,
tricycles, vans, handcarts, sledges, trucks, barrows and all other machines for the portage
of goods or persons.
Define Over taking
OVERTAKING – means passing or attempting to pass any other vehicle proceeding in
the same direction.
Registration of motor vehicles
No person shall, in any place, use or keep for use or, being the owner, permit any
other person to use or keep for use any other motor vehicle:
(a) not being a vehicle exempted from registration under this Act, unless it is
registered under this Act according to the procedures required by the Licensing
Authority or;
(b) being an agricultural tractor, agricultural trailer or industrial tractor, for any
purpose unless the Licensing Authority has granted its approval, in the prescribed
manner, of the use of the vehicles for that purpose.
(2) No person shall be liable to a penalty for a breach of this Section if he proves that he
had taken all reasonable steps to comply with its requirements, and when the vehicle
is in use on a road, that it is on its way for the purpose of being registered.
(5) If a motor vehicle does not bear on it a registration mark as required by the Licensing
Authority, this fact shall be regarded as prima facie evidence that the vehicle has not
been registered and any constable may detain such a vehicle until enquires have
been made.
Identification mark
The identification mark to be carried by a registered motor vehicle or trailer in pursuance
of Section 12 of the Act shall consist of two plates which must conform as to size lettering,

No person shall use a motor vehicle for a purpose other than that for which it is
registered.
Position of identification mark
The plates forming the identification mark shall be fixed, one on the front and the other on
the back of the motor vehicle or trailer, in an upright position, so that every letter or figure
on the plate is upright and easily distinguishable (in the case of the plate placed on the
front of the motor vehicle or trailer) from in front of the motor vehicle or trailer and (in the
case of the plate placed on the back) from behind the motor vehicle or trailer.
The registration of a motor vehicle shall remain valid so long as the vehicle is kept for
use and shall only be cancelled where the Licensing Authority is satisfied that:
a) the vehicle has been destroyed;
(b) the vehicle has been rendered permanently unserviceable,
(c) the vehicle has been permanently removed from Trinidad and Tobago;
(d) section 23(1) has been contravened; save as provided in this section—

(a) no motor vehicle exceeding the maximum gross
weight of fifteen tonnes;
(b) no trailer exceeding the maximum gross weight
of eight tonnes;
