Passive Breath tests vs Standard Breath Test
Passive
- initial test conducted roadside for RBT’s
- indicates prescence does not give a BAC
- if positive -> standard
- allows for rapid testing
Standard
- After pos passive test
- when police suspect alcohol consumption
- driver admits to drinking
- conditions aren’t favourable for passive
- driver in a MVC
- Standard BT before sobriety As.
PCA Ranges
0.001 - 0.019 Novice Range
0.020 - 0.049 Special Range
0.050 - 0.079 Low Range
0.080 - 0.149 Mid Range
0.0150+ High Range
Licence Class Novice Range Applies too
Learners, P1 and P2
unlicenced drivers who has never held a licence of any kind in australia
Licence Class Special Range applies too
- drivers whose licence is refused, cancelled, disqualified, suspended or expired for over 6mths
- driver of public passenger or coach
- driver of heavy vehicle (13.9T +)
- inappropriate licence - driving M vehicle with class C licence
Licence Classes
C - cars up to 4.5T GVM and 12 adults including driver
R - rider
LR - light rigid More then 4.5T but less then 9 GVM
MR - medium rigid - rigid vehicle with 2 axles and GVM of more then 8 tonnes and trailer is less then 9T
HR - Heavy rigid - 3 or more axles
HC - heavy combination
MC - multi combination
RTA s117 - Negligent Driving ELEMENTS
- driver of MV
- road/road related area
- drive negligently or
- at a speed or manner dangerous to public
Driving at a dangerous speed (s117)
involves a speed dangerous to other road users
not necessary for driver to be over speed limit
must prove speed was dangerous to public
driving in a dangerous manner (s117)
offence can be single act or a combo of driving offences that amounted to a danger
- e.g - speed, not give way, disobey traffic control signs and lights etc
RTA s118 - menacing driving
- driver of MV
- road/road related area
- drives in a manner that menaces another and
- intends to menace the person or
- ought to have known the person might be menaced
OFFENCE APPLIES
- regardless if person feels menaced or not
- by threat of injury or damage to property
- whether or not the person or property is on a road
EXAMPLES
- tailgaiting extremely close
- travel behding vehicle flashing lights and sounding horn
- speed in front of vehicle and break check
Criteria for major crash
- was any killed/injured
- any driver involve under influence of alcohol or drug
- did any driver fail to provide particulars (disobey Road rule 287)
