Section 22:
LTA 1998
- Stop
- Ascertain injury.
- Render assistance.
- Reporting (24hrs injury or death—-48hrs damage to property-owner—-60hrs damage to property to police if owner isn’t known)
Section 114:
LTA1998
Power to stop any vehicle. Must have: -flashing blue/red lights and/or siren. -uniform (hat + badge + high vis.). Power to: -demand details of the driver. -determine who the owner is.
4 major driving offences:
LTA 1998
- Inconsiderate (slow driving, not allowing pass).
- Careless (lack of attention, texting etc).
- Dangerous (excessive speeds etc).
- Reckless (knowingly committing a traffic offence).
Section 113:
LTA 1998
D-direct a person on a road to give details.
I-inspect any vehicle, equipment or documents.
M-move vehicles causing obstruction.
D-direct someone else to move a vehicle.
O-order/forbid an unlicensed driver to drive until they obtain the required licence.
D-direct drivers/pedestrians to stop or proceed. (Think white gloves).
Section 121:
LTA 1998
F-forbid to drive for a specified time.
A-all keys surrendered.
R-render the vehicle immobile.
M-move any vehicle causing obstruction or hazard.
E-EBA driver forbidden to drive for 12 hours.
D-direct someone to drive to a rest stop.
Section 115:
LTA 1998
Ordering vehicle off he road.
Pink Sticker:
- unsafe (public safety).
- must tow the vehicle.
- must take to a independent vehicle testing station.
Green Sticker:
- defective.
- can drive (must comply with directions given eg. straight home, to a garage etc).
- must get a new WOF.
Section 123:
LTA 1998
Seize and impound for 7days for forensic examination.
Section 122:
LTA 1998
Seize and impound for 12 hours for public safety.
Section 118:
LTA 1998
Require all information available of owner/hirer of any vehicle.
- after an offence committed after any act.
- 14 days to comply.
- immediately in the case of a fleeing driver (pursuit).
Section 96:
LTA 1998
Seized and impound vehicle for 28 days.
MUST seize if you believe on reasonable grounds:
-suspended driver.
-disqualified from holding or obtaining a licence.
-not holding a licence (expired or unlicensed AND had previously been forbidden to drive.)
-EBA reoffenders.
Section 95:
LTA 1998
Instant suspension of licence for 28 days.
- over 650mcg per litre of breath or over 130mgm per l00ml of blood.
- EBA reoffending.
- 40kph over permanent speed limit.
- 50kph over temporary speed limit.
Section 119:
LTA 1998
Power of entry by force if necessary to carry out EBA if you have GCTS driver has been driving under the influence of alcohol or drugs. AND Fresh pursuit: -enter any premises without warrant. -with force if necessary. -EBA the person.
Section 96(1a): (LTA 1998)
Boy racers section.
MUST seize and impound vehicle for 28 days if GCTS that:
-operated in a race or unnecessary exhibition of speed.
-deliberate sustained loss of traction.
